was ready one of my many blogs and came across this article about 'russet noon' - a tribute novel which is to follow breaking dawn in the twilight series (hahahahahahahahaha) - believe it or not the author of this work doesn't think she's infringing on Stephenie Meyer's copyright because

also as seen here where a FF writer tried to SUE the author of a popular series because they thought they stole their work (and should get half profits if the book was published) - the book was never published as result purely to avoid the mess of it.

So many author's have a policy of 'don't ask, won't tell' policy when it comes to FF because (and i didn't know this)

The reason is that in every book contract is a clause that says if a writer becomes aware of a copyright infringement on the Work, they are obligated to take action to have that infringement shut down.

If they don't, then their own publisher can sue them!


So this act of madness could actually spell the end of Twilight FF forever......Dun Dun duuuuun Laughing

There are several authors who don't let people write fanfiction of their work because of the sticky copyright issues. Other encourage it. There's a very good reason why we have to put disclaimers in our stories when we put them on Ramblings and Thoughts.

I can't believe she thinks they aren't copyright-ed, though. Rolling Eyes Some people...

Could this really cause a stir in the Twilight fanfiction community? I don't want to have to take my stories down. I don't want to stop writing them. Sad Ms. Meyer has been SUPER cool about letting people play with Twilight. Heck, as far as I know, we're allowed to make Twilight-inspired cafe-press stuff AND MAKE MONEY OFF OF IT (provided you put a disclaimer near the product info, of couse) but seriously! How many people allow that sort of thing? Oy.

Well on the writers comm thread its really interesting, cause what they've been saying is that author's pretend to not look at fanfics to cover themselves.

I did an article on this in one my blogs (too lazy to link it Laughing) but one authors' fans created a videogame of his novel (or something like that) but turned out he had sold the rights already had to ask fans to delete (a year of work) it because it was going to go legal. Now author felt terriable and gave them freebies and autographed stuff etc. but you can see why writers avoid it.

to be honest, this seems to happen in every fandom - i don't think if it was up to SM that shed ban it, but like the above author it might be taken out of her hand.

By the way, I doubt she will ever get through with this. Twilight fans are way too devoted to Stephenie Meyer to let that happen!

Ren: My Twilight Cafe Press stuff got flagged for copyright infringement, even the one that simply said "Twilight Ravelers" - as if the word Twilight was actually copyrighted!!

Aaaannyway...

We do a lot with copyrights here at work and when it comes to stuff like this the general "non-legal" rule is that if you aren't making money off it... most of the time no one's going to bother you. Like fanfic and stuff, no one's going to sue me cause I wrote a story about Edward and Bella. But if I tried to publish it and make some money... well I'm damn sure *someone* would sue me over it.

Ugh, I feel so bad for SM. Sad First the Midnight Sun leak, and now this? Why can't everyone leave this poor woman alone? D:

And I think this whole "Russet Noon" thing is a complete and utter waste of everyone's time. It's copyright infringement. End of story. I can't believe she's edging her way around this by saying "Oh she never had the characters drawn" or "Some of the cities used were actually real cities." God, woman, look at the front page of the book!

The author is a medium who channels these characters. The origin of all characters is the Shared Mind, the only mind that truly exists. Our minds are all one single ocean of shared memories, fantasies, dreams, nightmares and visions.

Just to name a few contemporary instances, characters like Edward Cullen, Jacob Black, Harry Potter and Anakin Skywalker are universal archetypes that get recycled by authors over and over again with just a few variations here and there. Such characters are far from being unique creations, since they share many traits with other literary portrayals from the past. They are just reincarnated versions of characters that conquered previous generations. In other words, there is an Edward Cullen for every generation, and this doesn't mean that the author who recycled him is a thief.

Laws that attempt to privatize the ownership of characters operate based on a delusion of separateness that we all share in this matrix we call reality. But according to Eckart Tolle, author of The Power of Now, there is no such a thing as separate minds. There is only one Universal Mind and it is the source of all our thoughts.

While this concept used to be considered an occult truth back in more conservative times, today it is a widespread awareness. This is the reason why modern science, especially the field of quantum physics, has started to accept the possibility of telepathy, clairvoyance and remote viewing.

We all share in this Universal Mind. Fictional characters have their origin in this shared mind. There is no such a thing as the author's individual mind. The individual mind is an ego creation. Authors write fanfiction and sell it all the time. They just change the identities of the characters to protect themselves from lawsuits. Unfortunately, when an author is honest about their unconventional views about fanfiction, they get called a "thief" and their ethical values come under attack. The only problem with this self-righteous, judgmental thinking is: How can you steal something that's already yours?

MissJulie - really? I got a thingy in the mail saying that you can make twilight related things as long as you dont use images from the movie, of the actors, artwork from the covers/posters, ect. It also said for movie-related stuff I had to put it under the keyword "Twilight Movie" but I didn't bother since mine was for the book, and it's my own vector art with some words. Like "It's Too Green" or something. Weird. Did you get it unflagged?

Yea, it was kind of a bruise to the ego... and patience. I didn't care enough to try and fix it. Actually, I didn't have the funds nor energy and time to fix it.

Well, if it's so easy, then why is Lady S writing a fanfic instead of "creating her own" characters? God, reading that article makes me sick.

Whatever strange mental disorder (the only reason for this madness) Lady S has, the writer has, too. Ugh.

I know! I forgot what site linked to it that I was looking at, but I wasn't sure if it was true. I think that's utterly ridiculous. But at least he can sue her, right? And maybe that will prevent her from publishing the novel. But, seriously, she can't even say it wasn't his because HIS NAME IS RIGHT ACROSS IT IN BIG LETTERS. Ugh, people are so stupid.

MoonLight - i know. its UNBELIEVABLE!! not to mention her taking SM story as well.

she'll probably get all of twilight fanfiction banned as a result, because most authors have a 'don't look, won't tell' policy because most have a clause in their contract saying they have to notify publishers if they know of any FF - cause its copyright etc.
